Part-time employees to earn Sunday premium pay under new rule

The Office of Personnel Management issued a final rule that revises Sunday premium pay regulations to eliminate references to full-time employees, which will allow part-time workers to earn Sunday premium pay. The regulations go into effect Sept. 22.

The rule, published in the Aug. 23 Federal Register, implements a federal appeals court ruling in Fathauer v. United States, which holds that part-time employees are covered under the statute governing the payment of premium pay for work performed on Sundays.

Consistent with that decision, OPM determined that prevailing-rate (wage grade) part-time employees who are regularly scheduled to work on Sundays are entitled to Sunday premium pay for the non-overtime hours they work.

Intermittent employees will continue to be excluded from earning Sunday premium pay under the new regulations, according to the final rule.
